Friday Finding: The First Lens—Laws and Rules

When evaluating any real estate decision, the first lens should always be the law. Federal laws establish a baseline for professional conduct. Laws such as the Fair Housing Act, RESPA, and Truth in Lending help protect consumers and create consistency across the country. States then build upon those requirements through statutes, regulations, and real estate commission rules. In Maine, licensees must comply with Title 32, Chapter 114, along with the rules established by the Maine Real Estate Commission. While ethical standards, company policies, and personal values are important, they cannot override the law.

If it's not legal, the analysis ends there.

 

Friday Finding: The law is the foundation of every ethical decision. Before asking what is ethical, ask what is legal.
